These Terms of Service (the “Terms”) govern your access to and use of getmakaan.com and any related websites, applications, communications, and services that link to these Terms (collectively, the “Platform”). The Platform is operated by Makaan (“Makaan,” “we,” “us,” or “our”), with a mailing address at Chicago, Illinois, USA.
By accessing or using the Platform, creating an account, submitting or claiming a listing, or purchasing a paid plan, you agree to these Terms and acknowledge our Privacy Policy. If you use the Platform on behalf of a business or organization, you represent that you have authority to bind it, and “you” includes both you and that organization. If you do not agree, do not use the Platform.
Additional terms displayed for a particular feature, promotion, or purchase also apply. If there is a conflict, the additional terms control only for that feature or transaction.
You must be at least 13 years old to use the Platform. If you are under the age of legal majority where you live, you may use the Platform only with the involvement and permission of a parent or legal guardian. You may not use the Platform if you are legally barred from doing so or if we previously suspended you for serious or repeated violations and have not authorized your return.
You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for activity under your account and for safeguarding your login method. Notify support@getmakaan.com promptly if you suspect unauthorized access.
You may not impersonate another person or business, create deceptive accounts, share an account in a way that defeats security controls, or create a new account to evade a restriction. A person claiming or managing a business or organization listing represents that the person is authorized to act for that business or organization.
Makaan is a curated community discovery platform focused on businesses, organizations, events, places, and resources that serve or are meaningfully relevant to Muslim communities. Unless we expressly state otherwise, Makaan is not the seller, restaurant, service provider, event organizer, employer, broker, religious authority, halal certifier, insurer, or agent of any listed third party.
Listings and event information may come from business owners, organizers, users, public websites, Google Maps Platform, other directories, or Makaan's research. Information can be incomplete, outdated, or incorrect. You are responsible for confirming material details directly with the relevant business or organizer before relying on them.
Submitting, suggesting, claiming, verifying, or paying for a listing does not guarantee publication, placement, ranking, duration, endorsement, or continued availability. Makaan may approve, reject, edit for format or clarity, categorize, merge, limit, suspend, or remove listings consistent with these Terms and our listing standards. We may prioritize coverage based on geography, category, community needs, information quality, and operational capacity.
Editorial discretion does not permit a submitter to demand publication. At the same time, Makaan applies neutral eligibility and moderation criteria and does not deny access to its listing or promotional services solely because of a person's race, color, religion, national origin, ancestry, sex, pregnancy, sexual orientation, gender identity, disability, age, military status, marital status, or another characteristic protected by applicable law.

A business does not have to be Muslim-owned to qualify. A non-Muslim-owned business may qualify when it meaningfully serves the community or fits the directory. Muslim ownership alone does not guarantee inclusion. We do not infer a person's religion from a name, appearance, language, ethnicity, nationality, address, or similar characteristic.
If we request clarification or verification, you agree to respond honestly and within a reasonable time. We may decline or remove content when we cannot verify essential facts, but we do not promise to investigate every listing or report.
Where available, an “Owner-identified Muslim-owned” designation is a voluntary representation submitted by an authorized business representative. The designation may be displayed publicly and used for filters, collections, and community discovery. It is not an endorsement, certification, or guarantee by Makaan.
The submitter is responsible for the designation's truthfulness and for updating or removing it when circumstances change. Makaan ordinarily relies on self-attestation and does not request proof of religious belief. We may ask the submitter to reconfirm the designation or remove the badge if it is disputed, misleading, inconsistent with our published badge definition, or no longer current.
Makaan is not a halal certification authority and does not issue religious rulings. Terms such as “halal,” “zabiha,” “halal options,” “pork-free,” and similar labels may be supplied by a business, user, public source, third-party certifier, or Makaan's research. Standards and interpretations differ, suppliers and preparation methods change, and cross-contact may occur.
Makaan does not guarantee that ingredients, sourcing, slaughter methods, kitchens, preparation practices, ownership practices, or services meet any particular religious standard. You should verify current information directly with the business and, when relevant, the named certifier. A listing, label, confidence indicator, or search result is informational only and is not an endorsement, certification, or fatwa.
If Makaan displays an AI-assisted or automated halal-confidence indicator, that indicator is an estimate based on available source information, may be wrong or incomplete, and must not be treated as certification. Businesses may request correction and users should independently verify.
A person who creates or claims a listing must provide truthful business information and have authority to act for the business. You may not claim a competitor, impersonate an owner, or submit false ownership, certification, or affiliation information. We may request reasonable verification, temporarily restrict editing while resolving a dispute, transfer control to a better-verified representative, or remove an unauthorized claim.
Business representatives remain responsible for prices, hours, policies, licenses, health and safety compliance, accessibility information, promotions, and all goods and services they provide. Claiming a listing does not create an agency, employment, franchise, partnership, or joint venture with Makaan.
If reviews, ratings, photos, responses, event submissions, messages, or other posting features are enabled, you retain ownership of content you submit (“User Content”). You represent that you have the rights needed to submit it and that it is based on genuine experience where represented as a review.
User Content must not:
Makaan may remove, restrict, label, or decline to distribute User Content under our moderation standards. A paid plan does not buy a positive review, removal of a lawful negative review, halal verification, or immunity from moderation. Businesses may respond to or report reviews through available tools.
You grant Makaan a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, store, reproduce, format, resize, crop, create thumbnails from, adapt for technical display, publish, display, distribute, and use your User Content only to operate, secure, improve, and promote the Platform and the listing or feature to which the content relates. This license allows our service providers to process content for those purposes.
The license ends when your User Content is deleted from active systems, except that copies may remain for a limited time in backups, legal or security records, content shared by others, or previously published promotional material where withdrawal is not reasonably practicable. You may request removal, but legal and operational exceptions may apply.
Event listings are informational. Unless Makaan expressly identifies itself as the organizer or ticket seller, the organizer is solely responsible for event accuracy, admission, capacity, accessibility, safety, conduct, cancellations, refunds, and performance. Makaan may link to third-party registration, RSVP, mapping, payment, or ticketing services. Those services have their own terms and privacy practices, and Makaan is not responsible for their operation, payments, cancellations, or data practices.
External links do not imply endorsement. Use of a third-party service is at your own risk and is a transaction between you and that third party.
Some listing details and gallery photos are supplied through Google Maps Platform. Google Maps photos remain subject to the applicable Google Maps terms and are credited with links back to their Google Maps source. By using those features, you also agree to the Google Maps Terms of Service and the Google Privacy Policy.
If Makaan offers paid plans, the price, billing frequency, included features, trial terms, taxes, renewal terms, and cancellation method shown at checkout form part of these Terms. Payments may be processed by Stripe or another payment processor, and you authorize the processor to charge the payment method you provide. Makaan does not store full payment-card numbers.
AUTOMATIC RENEWAL. Unless checkout states otherwise, a paid subscription continues and automatically renews for successive monthly or annual billing periods until cancelled. The payment method on file will be charged at the start of each renewal period at the then-current price disclosed to you, plus applicable taxes.
You may cancel an online subscription through the online billing portal or another easy-to-use online method identified at checkout or in your account. Cancellation stops future renewals and generally takes effect at the end of the current paid period. Except where required by law or expressly stated at checkout, we do not provide refunds or credits for partial billing periods.
We may change prices or plan features with reasonable advance notice. If Makaan terminates a paid plan without cause before the end of a prepaid period, we will provide a prorated refund for the unused period. No refund is required when termination results from fraud, chargeback abuse, unlawful activity, or a material violation of these Terms, except where law requires otherwise.
Makaan may offer featured listings, sponsorships, or promotional placement. Paid or sponsored placement will be identified clearly where required. Payment may affect visibility or placement but does not purchase positive reviews, religious certification, halal verification, factual accuracy, preferential dispute outcomes, or exemption from listing standards. Organic ranking may consider relevance, distance, availability, information completeness, user activity, quality signals, and other factors that may change over time.

You may report inaccurate listings, unsafe conduct, impersonation, infringement, or policy violations through available reporting tools or by emailing legal@getmakaan.com. We may investigate, request information, preserve relevant records, restrict content while reviewing a report, or take no action when a report is unsupported.
When reasonably practicable, a business or user affected by a non-emergency listing or account decision may request reconsideration by identifying the decision, providing accurate supporting information, and explaining why the decision should change. We do not promise a particular outcome or response time. We may act without advance notice when we reasonably believe urgent action is needed for safety, fraud prevention, legal compliance, security, or protection of others.
Makaan respects intellectual-property rights and may remove or disable access to content alleged to infringe copyright. A copyright owner or authorized agent may send a written notice to our designated agent containing: (1) a physical or electronic signature; (2) identification of the copyrighted work; (3) identification and location of the allegedly infringing material; (4) contact information; (5) a statement of good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the notice is accurate and the sender is authorized to act.
A user whose content was removed may submit a counter-notice containing the user's signature, identification of the removed material and its former location, a statement under penalty of perjury that removal resulted from mistake or misidentification, and the user's name, address, telephone number, and consent to the jurisdiction required by 17 U.S.C. Section 512(g). We may restore content as permitted by law after forwarding a valid counter-notice to the complainant.
Makaan may terminate accounts of repeat infringers in appropriate circumstances. Notices should be sent to Makaan, Chicago, Illinois, USA, legal@getmakaan.com. Knowingly misrepresenting infringement may create liability.
The Platform, including its software, visual design, selection and arrangement of content, branding, and original materials, is owned by Makaan or its licensors and is protected by applicable law. Subject to these Terms, Makaan grants you a limited, revocable, non-exclusive, non-transferable right to use the Platform for its intended purpose. No other rights are granted.
If you submit ideas or feedback, you grant Makaan a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided this does not transfer ownership of your separate User Content.
Our Privacy Policy explains how we collect, use, disclose, and retain personal information. By using the Platform, you acknowledge the practices described there. The Privacy Policy is not incorporated into these Terms as a contractual warranty beyond what applicable law requires.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” MAKAAN DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.
Makaan does not guarantee that the Platform will be uninterrupted, secure, error-free, or free of harmful components; that listings, reviews, religious information, event details, or third-party content are accurate or current; or that any business, organizer, user, product, or service will meet your expectations. You assume the risk of dealings with third parties and attendance at events. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKAAN AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM THIRD-PARTY SERVICES, EVENTS, USER CONTENT, OR UNAUTHORIZED ACCOUNT ACCESS, EVEN IF ADVISED OF THE POSSIBILITY.
To the maximum extent permitted by law, Makaan's total aggregate liability for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the amount you paid directly to Makaan during the 12 months before the event giving rise to the claim or (b) $100. These limitations do not exclude liability that cannot lawfully be limited, including liability for Makaan's willful misconduct where applicable.
To the extent permitted by law, you will defend, indemnify, and hold harmless Makaan and its owners, affiliates, officers, directors, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, and reasonable legal fees arising from your User Content, business listing, products or services, event, violation of these Terms, infringement of another person's rights, or misuse of the Platform. Makaan may control the defense of a matter subject to indemnification, and you agree to cooperate. This section does not require a consumer to indemnify Makaan for Makaan's own unlawful conduct.
You may stop using the Platform or delete your account through available account settings or by contacting support. We may suspend, restrict, or terminate access, remove content, or decline a listing if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay, or used the Platform fraudulently or harmfully.
When reasonably practicable, we will provide notice and an opportunity to request reconsideration. On termination, rights granted to you end immediately. Sections that by their nature should survive will survive, including content licenses to the limited extent described, intellectual-property provisions, payment obligations, disclaimers, liability limits, indemnification, dispute terms, and general provisions.
Before filing a lawsuit, you and Makaan agree to make a good-faith effort for 30 days to resolve the dispute informally. A notice must describe the claim, relevant facts, requested relief, and contact information and must be sent to legal@getmakaan.com. This requirement does not prevent either party from seeking urgent temporary relief, reporting to a government agency, or filing an eligible claim in small-claims court.
These Terms are governed by Illinois law, without regard to conflict-of-law rules, except to the extent federal law applies. Any court action arising from the Platform or these Terms must be brought in a state court located in Cook County, Illinois, or the United States District Court for the Northern District of Illinois, and each party consents to personal jurisdiction and venue there. Consumers retain any non-waivable rights under the law of their residence.
We may modify, suspend, or discontinue features and may update these Terms. We will post the revised Terms and update the effective date. If a change materially affects existing users, we will provide additional notice when reasonably practicable or legally required. Changes apply prospectively from their effective date. If you do not agree to revised Terms, you must stop using the Platform and cancel any affected subscription before the next renewal.
These Terms and applicable feature or purchase terms are the entire agreement between you and Makaan concerning the Platform. If any provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Makaan may assign them in connection with a merger, financing, reorganization, sale of assets, or transfer of the Platform. We are not liable for delay caused by events beyond our reasonable control. Headings are for convenience only.
